The FIAU would like to notify subject persons that AMLA is consulting on the draft Regulatory Technical Standards (RTS) relating to the respective duties of the home and host supervisors, and the modalities of cooperation between them under Article 46(4) of Directive (EU) 2024/1640, as well as the draft ITS for FIU cooperation.
Draft RTS for Home-Host Supervisory Cooperation:
The RTS provides a proportionate and efficient framework for cooperation between home and host supervisors of groups of obliged entities operating on a cross-border basis both in the financial sector and non-financial sector. It also examines AML/CFT supervisory colleges and cooperation guidelines by specifying the respective duties of home and host supervisors.
The proposed draft RTS aims to introduce a simplified disclosure regime within the EU supervisory framework, under which information may be shared among supervisory authorities without prior consent from the originating supervisor, subject to notification. Moreover, the draft RTS will feature provisions to facilitate cooperation between home and host supervisors, including the conduct of cross‑border inquiries and the coordination of activities through common approaches.
Therefore, AMLA is organising a public hearing wherein it welcomes all interested stakeholders to participate in a consultation on this draft RTS. The public hearing is scheduled for Thursday, 28 May 2026, 14:00 – 16:00. Further information on registration and the respective consultation paper can be found on AMLA’s website.
Draft ITS for FIU cooperation:
AMLA is consulting on three draft Implementing Technical Standards that introduce common formats for cooperation between Financial Intelligence Units (FIUs) and between AMLA, FIUs and the European Public Prosecutor’s Office (EPPO). Consistent and reliable information flows are as important to AML/CFT enforcement as the information itself. These three instruments strengthen how that information is shared, both between national FIUs and between AMLA, FIUs and the EPPO.
Two instruments govern how findings are reported to the EPPO when analysis reveals reasonable grounds to suspect offences against the EU’s financial interests. The first establishes the format FIUs must use; the second covers AMLA’s format for reporting findings from joint analyses. The instruments should ultimately make it easier to detect, investigate, and prosecute crimes against the EU’s financial interests. The third instrument introduces six standard templates for the exchange of information between FIUs on FIU.net, the secure channel for FIU cooperation across the EU. It strengthens the existing system by ensuring that information sent through it is more complete and consistent, reducing operational gaps and potential delays.
AMLA is organising two public hearings in relation wherein it welcomes all interested stakeholders to participate in a consultation on this draft RTS. The public hearings are scheduled for Wednesday, 27 May 2026, with a morning session from 10:00-12:00 covering the two EPPO reporting instruments, and an afternoon session from 14:00 – 16:00 covering FIU-to-FIU exchanges.
