AMLA Public Consultation: Draft RTS on the assessment of the inherent and residual risk profile of obliged entities in the non-financial sector under Article 40(2) of Directive (EU) 2024/1640

The FIAU would like to bring to your attention that the Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA) has launched a public consultation on the draft Regulatory Technical Standards (RTS) under Article 40(2) of Directive (EU) 2024/1640, the 6th Anti-Money Laundering Directive (AMLD6) concerning the assessment of the inherent and residual risk profile of obliged entities in the non-financial sector, and the frequency at which such risk profiles are to be reviewed.

This draft RTS sets out the methodology for assessing and classifying the money laundering and terrorist financing (ML/TF) risk profile of obliged entities in the non-financial sector, along with the proposed sector-specific data points. It also considers small entities, the operational feasibility of the reporting framework and the expected implementation costs and burdens. To reduce reporting costs and administrative burden, smaller entities will be required to report fewer data points than larger or more complex entities.

To provide supervisors and obliged entities with sufficient time to adapt to the new framework and implement the necessary processes, the draft RTS includes a deferred application date. It will apply from 31 December 2028, except for football agents and professional football clubs, for which the draft RTS will apply from 31 December 2029. Subsequently, supervisors are to continue using existing national methodologies to ensure risk-based supervision, until the new EU-wide approach becomes fully applicable.

AMLA has scheduled an online public hearing on the draft RTS, which will take place on 10 September 2026 between 10:00 and 12:00 CET.
