EBA Proposes Criteria to Appoint a Central Contact Point for CASPs to Strengthen the Fight Against ML/FT in Host Member States

The FIAU would like to inform subject persons that theEuropean Banking Authority (EBA) has initiated a public consultation on draft Regulatory Technical Standards (RTS) that outline the criteria for crypto-asset service providers (CASPs) to designate a central contact point to ensure adherence to the anti-money laundering and countering the financing of terrorism obligations of the host Member State.

The draft RTS outlines the criteria for determining when the appointment of a central contact point is necessary, as well as the functions of those central contact points. Since the same considerations apply to electronic money issuers (EMI) and payment service providers (PSPs) as they do to CASPs, the EBA proposes to maintain the structure and approach outlined in Commission Delegated Regulation (EU) 2018/1108, while extending the existing provisions to CASPs. This approach would leave the provisions for EMIs and PSPs unchanged, while introducing new provisions for CASPs where needed based on their business model and operations.
